Public Liability

This morning I got a call from my Ipoh cousin, I was very pleased and though she came down and wanted to meet up. Well, it wasnt the case. Her daughter - my niece got into an accident at a chalet in Pasir Ris and she came down to fetch her daughter home. She called to ask for help, given that his brother asked her to call me to enquire about Public Liability Claim issue against the Chalet organisation.

I was quite lost when I heard her explaining to me and asking me for help if I know anything abt the claim. Public liability is part of the law of tort which focuses on civil wrongs. An applicant (the injured party) usually sues the respondent (the owner or occupier) under common law based on negligence and/or damages. Claims are usually successful when it can be shown that the owner/occupier was responsible for an injury, therefore they breached their duty of care. The duty of care is very complex, but in basic terms it is the standard by which one would expect to be treated whilst one is in the care of another. Once a breach of duty of care has been established, an action brought in a common law court would most likely be successful. Based on the injuries and the losses of the applicant the court would award a financial compensation package. In order for her to claim against the chalet organisation, she will have to need a lawyer and the only person I could seek help from will be Daphne. Unfortunately, her husband is not in Spore. She promised to send me a contact that I could talk to.

I called HOH law firm to seek some advice. The lawyer secetary was very nice, she listened to me narrating my cousin case and advice me to make an appointment with their lawyer for a face to face consultation. If the pursue is to be carry out, my cousin may not need to fork out any laywer fee but if not the one time consulation for 30 min is going to $160.50. No wonder the lawyer making so much $$.
Now waiting to see if the chalet management going to compensate her or she is going to continue the claim case.
